DMCA Policy

Opere Varie respects the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy outlines our procedure for handling copyright infringement claims and counter-notifications.

We are committed to protecting the original content published on our site. We expect our users and content contributors to also respect copyright law. Unauthorized use of copyrighted material is prohibited.

Reporting Copyright Infringement

If you believe that any article or other content on operevarie.com infringes upon your copyright, please send a DMCA takedown notice to our designated agent. We will review all valid notices promptly.

Upon receiving a valid DMCA notice, Opere Varie will take appropriate action. This may include removing or disabling access to the infringing material. We will also make a good faith effort to contact the party who posted the material.

Elements of a Valid DMCA Takedown Notice

To be effective, your DMCA notice must include the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed. Provide specific details, such as the title of the work and registration number if applicable.
  • Identification of the material on operevarie.com that is claimed to be infringing. Include the URL where the material can be found.
  • Your contact information: name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

We encourage submitting notices via email for faster processing. Allow time for us to review and respond to your submission.

Counter-Notification Process

If your content was removed or access disabled due to a DMCA takedown notice, and you believe the removal was a mistake or misidentification, you may submit a counter-notification. This allows you to challenge the claim of infringement.

Opere Varie will forward your counter-notification to the original claimant. We will restore the material within 10 to 14 business days if the claimant does not file a court action seeking an order against you. This restoration occurs at our sole discretion and only if legally appropriate.

Elements of a Valid DMCA Counter-Notice

To be effective, your DMCA counter-notice must include the following information:

  • Your physical or electronic signature.
  • Identification of the material that was removed or to which access was disabled. Include the URL where the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located. If your address is outside the United States, you consent to jurisdiction in any judicial district in which Opere Varie may be found. You must also accept service of process from the person who provided the original DMCA notification.

Please send your counter-notification to: [email protected]

Repeat Infringer Policy

Opere Varie reserves the right to terminate the accounts of users who are repeat infringers of copyright. We will take reasonable steps to identify and address repeat infringements by our content contributors.

Users who repeatedly post infringing articles or other material will have their accounts suspended or terminated. This policy protects both copyright holders and the integrity of our publishing platform.
